Disabled persons rights

HOW TO DEFINE THE DISABILITY?

According to art.37 of the Law “On citizens’ health protection”, medical and labour expertise defines the reasons and degree of disability, degree of citizens’ working ability loss, determines types, volumes and period of their rehabilitation and measures on social protection, issues the appropriate conclusions, which are mandatory for the management of enterprises, institutions, organizations and public unions.

RIGHTS OF DISABLED PERSONS TO GET EDUCATION

AND PROFESSION

According to Chapter 4 of the Law «On social protection of disabled persons in the Republic of Uzbekistan»:

Preschool education of disabled kids is conducted at the preschool educational institutions including boarding schools.

General secondary, vocational and professional and higher education of the disabled persons is provided in educational institutions, and if necessary – at the specialized educational institutions.

• Professional training and retraining of the disabled persons is provided in educational institutions, including the specialized educational institutions and at the enterprises of the disabled persons’ public unions. 

GUARANTEES OF DISABLED PERSONS IN WORKING ACTIVITIES

According to Chapter 5 of the Law «On social protection of disabled persons in the Republic of Uzbekistan»:

Disabled person is entitled to work in organizations with normal working conditions, at the specialized enterprises, workshops and areas using a labour of disabled persons, and also to conduct individual labour or other activities.

Subject to demand of disabled persons and local peculiarities are created the specialized enterprises, workshops and areas to use a labour of disabled persons.  Disabled persons on eyesight have a priority right to take part in manufacturing places conditions of which correspond to their capabilities.

At enterprises, institutions and organizations with a personnel exceeding 20 persons is set and reserved a minimum number of jobs for resettlement not less than 3 percent of a number of employees.

Public authorities at the sites and organizations render a necessary assistance to the disabled persons conducting entrepreneurship activities through provision of nonresidential premises, purchase of raw materials and production distribution.

According to the Regulation on order of reserving places for persons seeking social protection and facing difficulties in job search, work places reserved for disabled persons should have:

      parents with many kids and having disabled children – flexible working schedule allowing to harmonize tasks on kids upbringing and labour commitments;

      for disabled persons certified based on labour conditions allowing an employee (subject to his/her health condition and restrictions to labour activities) to implement working processes without obstacles 

HEALTH PROTECTION OF DISABLED PERSONS

According to art.22 of the Law «On citizens’ health protection»:

Disabled persons, including disabled children and handicapped persons from childhood, have a right to medical and social assistance, to all types of rehabilitation, provision of drugs, orthopaedic items, vehicles at beneficial terms, and also to professional training and retraining.

Disabled persons have a right to free medical and sanitary assistance at the institutions of public health system, labour and social protection of population, care at home, and lonely disabled persons in need of outside care and disabled persons with psychic diseases – to housing at institutions of labour and social protection of a population.

According to the art.28 of the Law «On guarantees of the rights of a child», disabled children have a right to free medical and social assistance at the institutions of public health system, labour and social protection of population, and care at home.

GUARANTEES OF SOCIAL PROTECTION OF DISABLED PERSONS

According to art.26 of the Law «On social protection of disabled persons in the Republic of Uzbekistan», social assistance to the disabled persons is provided in a form of:

monetary payments (pensions, wages, lump sums);

provision of technical and other means, including automobiles, wheelchairs, orthopaedic items, publications with special fonts, sound amplifiers and signaling devices;

services of medical, professional and social rehabilitation and communal services;

transportation services;

 provision of drugs.

In accordance with the Law  «On adjustment of a free use of the city public transport», disabled veterans of the War in 1941-1045 and a person accompanying disabled person of the 1st category, blind persons and persons accompanying such persons have a right to free use of the city public transport (except taxi).

According to the Resolution of the Cabinet of Ministers of the Republic of Uzbekistan №532 of February 2, 1997 «On improvement of the financial provision system of medical and preventive institutions », handicapped persons from childhood,  disabled persons of the 1st and 2nd categories, disabled veterans of the War in 1941-1045, and also persons equated to them, disabled persons participated in liquidation of disaster at the Chernobyl atomic plant are exempted from food payment at the medical and preventive institutions.
